- Two of our attorneys represented a major title insurance company in the Ameriquest Mortgage Lending Practices MDL, which involves individual and class action claims against title insurers, closing agents and mortgage brokers. These third party claims arose out of alleged violations of the Truth-in-Lending Act, as well as state law claims for breach of contract and negligence. Our attorneys filed a motion to dismiss these claims on behalf of all third party defendants, and this motion was recently granted in substantial part.
- Our attorneys defended the mortgage servicing arm of a national bank in a nationwide class action pending in Madison County, Illinois, which challenged the client’s method of charging interest on paid-off loans. After obtaining summary judgment for the client, our attorneys successfully argued the appeal before the Illinois Appellate Court.
- We won a favorable verdict for a national retailer in a federal trial. The plaintiff sought $1.5 million in damages, including lost profits, for the alleged delivery of defective equipment. Our client counter-sued for non-payment of the delivered goods. The court found in favor of our client on every issue and awarded our client all of its damages, nearly $500,000.
- We convinced the Illinois Department of Revenue (“IDR”) to voluntarily withdraw a six-figure collection action against a client. IDR had sought to impose personal liability on the client for the tax debts of a defunct business with which the client had once been affiliated. We proved that our client’s involvement in the business had been very limited and that, consequently, he was not liable for the business’s tax obligations. As a result of quick, efficient intervention, the IDR action was withdrawn before the matter advanced to the costly hearing stage, creating substantial savings for our client.
